Medical malpractice claims, which include misdiagnosis, failure to treat, botched surgeries and many more, can result in substantial compensation to injured victims and their families. While every situation is different, residents in some states tend to receive more in medical malpractice payouts – and Florida is in the top five.
Payouts On Florida Med Mal Injuries Resulted In Over $200 Million In 2012
Florida was number five out of 50 on the list of the medical malpractice payout states in 2012 with recoveries of over $200 million. According to recently published data from Becker’s Hospital Review which reflect national medical malpractice payouts and statistics for 2012, of the $3.6 billion in medical malpractice payouts nationally, these states had the highest payouts:
New York: $763,088,250
Pennsylvania: $316,167,500
California: $222,926,200
New Jersey: $206,668,250
Florida: $203,671,100
While that’s certainly good news for Florida residents, the question remains – what causes these types of injuries? According to Becker’s, the majority of medical malpractice claims consisted of injuries related to diagnosis, surgery, treatment, obstetrics and medication. Of those claims, the highest percentage of allegations involved wrongful death, significant permanent injuries and major permanent injuries.
3 Common Sources Of Medical Malpractice
While medical malpractice can happen anywhere, the three most common sources are likely hospitals, nursing homes and doctors.
Hospitals. Hospital errors, including diagnostic errors, delayed diagnosis, surgical errors, operations on the wrong body part, anesthesia errors, medication errors, foreign objects left inside patients, birth injuries, hospital-acquired infections and emergency room errors are more common than most people think. While accidents happen, the bottom line is that you shouldn’t have to pay the price.
Doctors. While most doctors strive to deliver quality care, it has to be recognized that even the most highly trained doctors can be careless and make mistakes. Doctors, and other healthcare professionals, are held to a higher standard of conduct and should be held responsible for their actions.
Nursing Homes. Nursing home residents, of which Florida has many, are dependent upon doctors, nurses and nursing home staff for their care. However, many nursing homes are notorious for charging residents exorbitant amounts of money and then abusing or neglecting them. These types of nursing home abuse can result in pressure ulcers (bed sores), improper use of restraints medication errors and physical abuse – all of which can be actionable medical malpractice claims.
